PROGRAM RULES

PLEASE READ CAREFULLY. By participating, you agree to the following rules governing the aFANity Rewards Program, including any changes that are made to the Program after you enroll. The date above indicates the date of the most recent change in the Program Rules.

1. Overview of the aFANityRewards Program:

The aFANity™ Rewards Program (the "Program") is a program sponsored by Chevron Products Company, a division of Chevron U.S.A. Inc. (“Chevron” or "Sponsor") in which individuals can participate in "Activities” (defined in Section 5, below) through interacting with the Sponsor, its products, customers, and other entities. Members of the Program (“Members”) can earn points by registering for the Program, connecting their social media accounts, connecting their Chevron and Texaco Techron Advantage™ Credit Card, Chevron and Texaco Techron Advantage™ Visa® Card, or another eligible Visa® Card (“Connected Payment Card”) and making purchases with their Connected Payment Card(s) at any Chevron, Texaco or ExtraMile store location in the participating areas, or through other methods as may be added from time to time. Members may redeem their points for merchandise or other items of value or use their points to participate in sweepstakes or other Activities, or for other purposes as described below.

2. Participating Areas and Eligibility:

The Program is available only in the following states: Alabama, Arizona, California, Florida, Georgia, Idaho, Louisiana, Mississippi, Nevada, New Mexico, Oregon, Tennessee, Texas, Utah, Washington, and Wyoming. Members must be 17 years or older and legal residents of these states at the time of enrollment in order to participate. Some Activities (e.g., sweepstakes) or rewards may be available only to those of other ages (always older than 17, e.g. 18 or 21), as indicated in the rules/instructions for the particular Activity, or reward description. Only individuals can be Members of the Program; Corporations, business associations or groups may not participate. The Program is void where prohibited by law.

Employees, officers, and directors of Chevron, AdSport, Inc. (“Administrator”), their subsidiaries, divisions, affiliated companies, advertising and promotion agencies and those associated with this Program (collectively the “Program Entities”) as well as their immediate families (spouse, parents, siblings and children) and household members are not eligible to participate.

3. Duration of Program:

The Program begins at 12:00 a.m. Eastern Time ("ET") on September 1, 2018 and is scheduled to end at 11:59 p.m. ET on December 31, 2018 (the "Program Period"), but Sponsor reserves the right to shorten, extend, suspend, modify, or cancel the Program or Program Period, at its discretion, at any time. Members may redeem points at any time during the Program Period as set forth in Section 7 below, until the Redemption Deadline as provided in Section 7. Members can earn points by the methods set forth in Section 6 below.

4. Enrolling in the Program:

How to Become an aFANity Rewards Program Member: If you are an individual who is 17 years of age or older and you meet the other eligibility requirements stated in these Program Rules, you may register for the Program by:

A. Visiting www.afanity.com (“Website”) and follow the prompts to register by completing and submitting the registration form with your first and last names, date of birth, state of residency, and a valid email address.

B. Or by downloading the free Chevron or Texaco mobile app (“App”) onto your Web-enabled smartphone. Once the App is installed, click on the Promotions tab and follow the prompts to register by completing and submitting the registration form with your first and last names, date of birth, state of residency, and a valid email address.

An individual must have a unique, valid email address to become an aFANity Rewards Program Member.

To participate in Activities on social media platforms, a Member must follow the links and instructions to link his/her social media accounts to his/her Program account (“Program Account”).

Limit : Limit one (1) Program Account per individual, under all circumstances. Do not create a new Program Account if you are already a Member. The person who is the authorized email account holder of the email address indicated when registering will be the Member. That person must provide his or her name, date of birth, and state of residency when registering for a Program Account. If a Member is eligible for any prize via any Activity, or for any physical reward or other item, he or she will need to have a valid physical address linked to his or her Program Account (PO Boxes are not valid addresses). If a Member does not provide a physical address when required, or if his or her email address is deemed to be invalid, Sponsor reserves the right not to fulfill the prize, reward, or other item, to invalidate the Member's participation or win, and/or to lock the Member's Account, in Sponsor’s sole discretion. Any attempt by any individual to exceed any specified limits by using multiple/different accounts, email addresses, identities, registrations and logins, or any other methods will void that individual’s entries and/or rewards, and that individual may be disqualified from participating in any of Sponsor’s promotions or programs. If your name, email address, and/or address information on your Program Account are not accurate, you may not be eligible to participate or win a prize or receive a reward. Any use of robotic, repetitive, automatic, programmed or similar point earning or entry methods or agents (including, but not limited to, sweepstakes entry services) will void all points, entries and/or rewards for that individual.

5. Activities:

During the Program Period, Sponsor may offer individual activities (“Activities”) which may earn individual Members points who participate in that Activity that can be used towards prizes or rewards. Activities may include, but are not limited to, promotional code redemptions, social media activities, valid purchases at participating Chevron and Texaco stations, and “checking in” at a participating Chevron or Texaco station.

6. Earning Points:

1 There is a limit of one of each type of social media account that may be connected to a Member’s Program Account.

2 It may take up to three (3) business days after connecting your card before you are able to earn points for making a purchase and up to seven (7) calendar days from the purchase date for earned points from that purchase to appear in your Program Account. By connecting your payment card to your Program Account, you are expressly authorizing the Program Administrator to access or otherwise receive information about purchases made with the Connected Payment Card in the participating areas during the Program Period (“Transaction Information”) from third-party card issuers, networks, providers, platforms, processors or any other transaction facilitators or point-of-sale systems (i.e., Visa, Synchrony Financial, etc.) (“Transaction Information Providers”) for the limited purpose of determining if any points were earned under this Program. Transaction Information may include, but is not limited to, the name of the merchant, retailer, etc., the dates and times of your purchases or returns of products and services, the location of your purchases or returns of products and services, the amount of your purchases and the products or services purchased using your Connected Payment Card. By connecting your payment card to your Account, you are expressly authorizing the Program to access or otherwise receive your Transaction Information from the Transaction Information Providers, and to use the Transaction Information to determine any points that you are eligible to receive. The Program will only use your Transaction Information for those specific purposes, notwithstanding anything to the contrary in the Privacy Policy.

Not all Visa cards are eligible for registration in the Program. Visa Corporate cards, Visa Purchasing cards, non-reloadable prepaid cards, government-administered prepaid cards (including EBT cards), healthcare (including Health Savings Account (HSA) or Flexible Spending Account (FSA) or insurance prepaid cards, Visa Buxx, and Visa-branded cards whose transactions are not processed through the Visa U.S.A payment system are not eligible to participate.

Not all transactions with your registered card are tracked by the Transaction Information Providers. You acknowledge that the Transaction Information Providers may be unable to monitor every transaction made with your enrolled card, including PIN-based purchases, purchases you initiate through identification technology that substitutes for a PIN, payments made through other payment methods (such as a digital wallet or a third party payment app, where you may choose your card as a funding source but you do not present your card directly to the merchant), payments of existing balances, balance transfers, or transactions that are not processed or submitted through the Transaction Information Providers' payment systems, and that these transactions are not eligible.

If you register a debit card, your transaction must be processed as a ‘credit’ (i.e., signature) transaction to make sure the transaction can be monitored. Do not use a Personal Identification Number (PIN) when paying for your purchases with your enrolled card if you want the transaction to be eligible to earn points.

Earned points will appear in your Program Account as outlined above. Some Activities may not be available during the entire Program Period. Sponsor reserves the right to change, add, or remove Activities by which Members can earn points or the number of points Activities can earn at any time during the Program Period.

Promotional codes can only be redeemed one time, unless otherwise specified. It is a violation of the Program to combine promotional codes obtained by others for deposit into a single Program Account, and/or to transfer or sell promotional codes under any circumstance, other than in programs authorized by Sponsor. It is fraudulent for any individual or company, business association, or group to direct, encourage, or allow individuals to use a single Program Account for the purpose of earning points for combined use. Any attempt to combine or transfer promotional codes or points will result in that Member’s disqualification from the Program and forfeiture of all points in the Member’s Program Account. Sponsor reserves the right to take any action it deems appropriate, in its sole discretion, in the event that it believes that any Member has violated any of these provisions.

If a Member believes that points were not properly applied to his/her Program Account, the Member must notify Sponsor by using one of the communication options in the Support page, within 15 days of the date the points were earned.

Sponsor reserves the right in its sole discretion to remove points previously credited to a Member’s Program Account or other value obtained from an Activity, if it is determined that the points were not earned in accordance with these Program Rules and through legitimate channels. Sponsor’s decisions regarding removing points are final and binding.

Members may earn points by any of the methods set forth above during the Program Period, as that period may be extended, shortened, or otherwise modified by Sponsor.

7. Point Redemption:

A. Members may redeem their points for merchandise, discounts, sweepstakes entries, instant win plays, offers, and other items of value (all, “Rewards”) listed in the applicable “Rewards Store.” The Website will list the corresponding point values required to be redeemed for each item. Each Member must comply with any individual Rewards limitations indicated in the Program. The items listed in the Rewards Store may not be in stock at all times as available items are redeemed and additional items are added by Sponsor. Sponsor reserves the right to modify the point value(s) for Rewards, at any time and for any reason, during the Program Period. All redemptions are subject to these Program Rules and all limitations and/or requirements specified on the Website.

B. To spend/redeem points, navigate through the items listed in the Rewards Store. A Member may choose any item still available in the Rewards Store for which he or she has earned sufficient points for redemption, then he or she must click on the image corresponding to the item and follow the links and instructions to complete the redemption process. As part of the redemption process, Member will receive a confirmation email and when applicable, an email containing the actual item redeemed in the form of a digital code, coupon, etc. Emails will be sent to the email address assigned to the Member’s Program Account.

C. Each Member is responsible for ensuring the accuracy of his/her information and is encouraged to check "Settings" in his or her profile regularly. Each Member is responsible for ensuring that the email address, name, and the mailing address associated with his/her Program Account are accurate and up to date, as well as the social media accounts that Member has connected to their Program Account. There is a limit of one of each type of social media account that may be connected to a Member’s Program Account. Sponsor is not responsible for non-receipt of a prize or Reward that was sent to the email address or the mailing address listed in the Member's Settings or that the Member has provided. Changes to a Member's information may only be made by the Member. Sponsor is not responsible for any incorrect or inaccurate information supplied by any Member participating in the Program.

D. All point redemptions are final. Refunds, exchanges and other issues regarding the product redeemed are governed by the vendor’s terms and conditions applicable to the purchase of that product and are not the responsibility of Sponsor.

E. Members may redeem points in the manner set forth above until April 30, 2019, at 11:59 p.m. ET, unless shortened, extended, or otherwise modified by Sponsor (“Redemption Deadline”).

8. Inactivity and Forfeiture:

A. ­If a Member fails to either earn points in their Program Account by the end of the Program Period or redeem points from their Program Account by the Redemption Deadline, the Member will forfeit any points remaining in their Program Account, without compensation.

B. At the end of the Redemption Deadline, unless the Program is extended by Sponsor, Member’s forfeit any points remaining in their Program Account and/or any unclaimed Rewards or prizes associated with their Program Account, without compensation.

9. Modifications and Termination of the Program:

Sponsor reserves the right to modify any of the Program Rules or Program details set forth herein, including, but not limited to, the duration of the Program Period, and methods by which Members may participate or Activities that earn points, at any time, with notice, which may be in the form of email, site updates, or by other means, even though these changes may affect a Member's ability to earn points or to participate in Activities. Sponsor reserves the right to terminate or temporarily suspend the Program at any time, for any reason, with notice, even though termination may affect a Member's ability to earn points or participate in Activities. In the event of an early termination, Members will have thirty (30) days from the date that the Program termination is announced to claim any unclaimed Rewards and/or prizes. A Member's continued participation in the Program constitutes the Member's acceptance of any changes to these Program Rules. Members are responsible for remaining knowledgeable of any changes that Sponsor may make to these Program Rules. The most current version of these Program Rules, which will indicate the date they were last updated, will be available on the Program Website and will supersede all previous versions of these Program Rules.

10. General Program Rules:

A. Some Rewards have no cash value and are only benefits of participation in the Program. Prizes and other Rewards with cash value may be available through the Program, through the Rewards Store or otherwise.

B. To learn how the personal information collected in connection with the Program may be used, Members should read Sponsor's Privacy Statement which is available HERE. The terms of Sponsor's Privacy Statement are incorporated herein by reference.

C. Sponsor reserves the right to discontinue the participation privileges of any Member who engages in any fraudulent or unsportsmanlike activity or uses the Program in a manner inconsistent with these Program Rules or with any federal, state or local laws, statutes or ordinances. Discontinued participation privileges may result in the loss of all earned points, Rewards, and/or prizes that have not yet been redeemed or utilized. In addition, Sponsor shall have the right to take appropriate administrative and/or legal action, including criminal prosecution, as it deems necessary in its sole discretion.

D. Sponsor reserves the right to rescind points, Rewards, and/or prizes that have not yet been redeemed or utilized, even if they have been credited to a Member’s Program Account, which were obtained as a result of fraudulent or unsportsmanlike activity or technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software related to the Program.

E. Points, Rewards, and/or prizes that have not yet been redeemed or utilized are not the property of a Member and may be revoked at any time by Sponsor and/or its Rewards and prize providers as set forth herein, and they may not be transferred or assigned, except as specifically permitted by Sponsor from time to time. All questions or disputes regarding eligibility for the Program, collecting or redemption of Rewards, prizes, and/or earning points or a Member's compliance with these Program Rules will be resolved by the Sponsor in its sole discretion.

F. Members are responsible for the payment of all taxes, if any, which may result from the Rewards or prizes received as part of the Program.

11. General Conditions:

Sponsor reserves the right to cancel, suspend and/or modify these Program Rules, the Program, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Program, as determined by Sponsor and/or Administrator in their sole discretion. Sponsor and/or Administrator reserve the right in their sole discretion to disqualify any individual they find to be tampering with the point system or the operation of the Program or the Website or to be acting in violation of these Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Program may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Program Rules shall not constitute a waiver of that provision.

12. Limitations of Liability:

The Program Entities and Transaction Information Providers (as defined in Section 6) are not responsible for: (1) any incorrect or inaccurate information; (2) unauthorized human intervention in any part of the Program; (3) technical or human error that may occur in the administration of the Program; (4) any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from Member’s participation in the Program or receipt or use or misuse of any Reward or prize. No more than the stated number of Rewards and prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of items and/or Rewards in the Program to be bid upon, available and/or claimed Sponsor reserves the right to award only the stated number of items and/or Rewards by a random drawing among all legitimate, unawarded, eligible members for that particular item and/or Rewards. By participating in this Program, Members hereby agree to release and hold Sponsor, Administrator, and Transaction Information Providers harmless from and against all losses, damages, liabilities, claims, actions, proceedings, or judgments arising out of or relating to Member’s participation in the Program, use or misuse of any Rewards, items or sweepstakes prizes, if applicable, awarded or any use of the Member’s name, likeness, photograph, voice, opinions and/or hometown and state.

13. Disputes:

Except where prohibited, participants agree that: (1) any and all disputes, claims and causes of action arising out of or connected with this Program or any Reward or prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by arbitration to take place in the state of California pursuant to the Rules of the American Arbitration Association, then effective, in accordance with the laws of the State of California, without regard to its choice of law rules. The parties hereto consent to the jurisdiction and venue of the federal, state and local courts located in the Contra Costa County, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Program, but in no event will attorneys’ fees be awarded; and (3) under no circumstances will participants be permitted to obtain awards for, and the participant hereby waives all rights to claim indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Program Rules, or the rights and obligations of the participant and Sponsor in connection with the Program, shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California
